Terms of Service
Before using Suwaripocket, you must read and agree to all provisions of these Terms of Service (hereinafter referred to as "these Terms").
1. Definitions
The definitions of terms used in these Terms shall be as follows:
- "Service": The service provided by Suwaripocket.
- "Site": The website where the Service is provided (area within https://suwaripocket.com/).
- "Use of the Service": The act of accessing the Site and browsing the Service or posting information.
- "Information": Information provided through the Service, collectively referred to as "Basic Information" and "Posted Information".
- "Basic Information": The content of "Map Information" among the Information.
- "Weather Information": Data provided by the Japan Meteorological Agency and estimation information based on this.
- "3D City Model": 3D city model data from PLATEAU provided by the Ministry of Land, Infrastructure, Transport and Tourism.
- "Map Information": Map information using the Google Map service provided by Google, Leaflet, and the map service provided by GraphHopper.
- "Posted Information": Information on rest areas/benches on the map or posting pages posted by users among the Information.
- "Rest Area": A place where users can temporarily rest in the Service (benches, chairs, sofas, seats in facilities, other places suitable for resting).
- "User": A user of the Service.
- "Member": An individual who agrees to these Terms, registers for membership, is admitted by the Site, and can receive the Service.
- "Basic Information Provider": A provider of Basic Information other than the Site.
- "Poster": A user who posts Posted Information.
- "Sponsor": A contract form that allows enjoyment of part of the Service through monthly recurring billing.
- "Sponsor Member": An individual among Members who has signed a Sponsor contract.
- "Marche": A contract form that allows use of Suwari Marche, which is part of the Service, through monthly recurring billing.
- "Marche User": An individual or corporation among Members who has signed a Marche contract.
2. Purpose and Operating Policy
The Site operates based on the following intent:
- This Service aims to support comfortable outing experiences and improve the urban environment through sharing information about rest areas among users.
- Rest areas in facilities are introduced as places to rest temporarily on the premise of facility use (shopping, dining, service use, etc.).
3. Application of these Terms
These Terms of Service serve as an agreement between this Site and the User for using the Service, and apply to all acts when the User uses the Service.
Use of the Service is conditional upon agreeing to and complying with these Terms. By using the Service, the User is deemed to have agreed to be bound by these Terms.
4. Amendment of these Terms
This Site may, at its discretion, amend these Terms at any time for any reason. The amended Terms shall take effect from the time they are posted on this Site by this Site, unless otherwise specified by this Site.
5. Change, Suspension, or Termination of the Service
The Service may be changed, suspended, or terminated without prior notice due to system maintenance, inspection work, force majeure such as natural disasters, convenience of the Site's membership service, or other various circumstances. In such cases, this Site and the Basic Information Provider shall not be responsible for any damages caused by the change, suspension, or termination of the Service.
6. Prohibited Acts
Users must not engage in any of the following acts or acts that the operator judges to fall under these categories when using the Service.
(1) Acts that violate laws or are related to criminal acts
(2) Acts of fraud or intimidation against the operator, other users, or third parties
(3) Acts contrary to public order and morals
(4) Acts that infringe on the intellectual property rights, portrait rights, privacy rights, honor, or other rights under law or contract of the operator, other users, or third parties
(5) Posting or sending information to the operator through the Service that falls under or is judged by the operator to fall under the following:
- Information containing excessively violent or cruel expressions
- Information containing computer viruses or other harmful computer programs
- Expressions that damage the honor or credit of the operator, other users of the Service, or third parties
- Information containing excessively obscene expressions
- Expressions that promote discrimination
- Expressions that promote suicide or self-harm
- Expressions that promote the inappropriate use of drugs
- Information containing antisocial expressions
- Information seeking the spread of information to third parties, such as chain mail
- Expressions that cause discomfort to others
- Expressions intended for harassment or slander
- Information contrary to or unrelated to the purpose of the Service posted on the operator's website
- Expressions that mock other users or incite conflict between users
- Information (including photos) obtained through acts prohibited in facilities
(6) Acts for the purpose of business, promotion, advertising, solicitation, or other profit-making by the user themselves or a third party (including but not limited to the user's workplace or a corporation managed by the user) without the operator's permission, such as asking other users to post or click "Like" regardless of whether consideration is provided, or editing facility information for promotional purposes. This includes the use of information on this Service for commercial data analysis and development of proprietary services such as AI.
(7) Acts of intentionally spreading false information
(8) Acts of unauthorized access or using registration information of other members of the Service
(9) Acts of collecting all data (including posted content) that constitutes the operator's website (including but not limited to scraping, crawling, AI training, artificial intelligence development, and training of machine learning models), registering accounts or accessing the Service using automated means (information gathering bots, robots, spiders, scrapers, etc.), acts of reproducing, modifying, reprinting, altering, changing, reverse engineering, disassembling, decompiling, translating, or analyzing the functions provided by the Service, acts of using all data (including posted content) that constitutes the operator's website without the operator's permission regardless of how it was obtained, acts that interfere with the Service's servers or networks, and acts that hinder the operation of the Service or the use of the Service by users. However, this is not the case if the operator judges that all of the following are met: it is for private use by an individual and not for commercial purposes, it is done in a way that does not place a burden on the Service's servers or networks (limited to about once every 10 seconds), and in the case of disclosing analysis results of information obtained through such acts to third parties, it is for the purpose of the healthy development of the industry including the users (the method and target of disclosure are not limited, but it must be indicated that information obtained from this Service was used).

(15) Acts of registering or editing rest areas based on incorrect information while recognizing it is incorrect, or when an ordinary person could easily recognize it as such.
(16) Acts of registering or editing facility information without adding any information.
(17) Acts of registering or editing information of non-existent facilities or facilities that have already ceased operation.
(18) Acts of seeking membership registration despite already being registered as a member.
(19) Provision of benefits to antisocial forces, etc.
(20) Acts for the purpose of meeting strangers (not limited to the opposite sex) for sexual acts or obscene acts.
(21) Purchase of products for the purpose of resale and resale or reproduction/processing of purchased products.
(22) Acts that directly or indirectly cause or facilitate the acts in the preceding items.
(23) Attempting the acts in the preceding items.
(24) Use of images from this Site in a way that falls under defamation of the subject or creator, or use contrary to public order and morals, and the act of unjustly processing and distributing images.
(25) Other acts that the operator judges to be inappropriate.
7. Handling of Personal Information
The handling of users' personal information by the operator shall be as stipulated in the separate "Privacy Policy", and the user agrees to the operator handling the user's personal information in accordance with this "Privacy Policy".
8. Disclaimers
The operator of this Site shall be disclaimed from the following matters:
- The operator of this Site does not guarantee, explicitly or implicitly, that the Service is suitable for the user's specific purpose, has expected functions, product value, accuracy, or usefulness, that the user's use of the Service conforms to laws and regulations applicable to the user or internal rules of industry groups, etc., that it can be used continuously, or that malfunctions will not occur, and assumes no obligation to the user to remove flaws related to these.

- Accuracy of Weather Information and 3D City Model Data: Information such as shade determination displayed in this Service is based on estimates using weather data from the Japan Meteorological Agency and 3D city model (PLATEAU) data from the Ministry of Land, Infrastructure, Transport and Tourism, and may differ from the actual conditions on-site (temporary obstacles, changes in vegetation, latest building conditions, etc.). Due to the nature of the information, accuracy, completeness, and usefulness are not guaranteed.
- Damages from use of Weather Information, etc.: The operator shall not be liable for any disadvantages or damages incurred by users as a result of referring to weather information, shade determination, etc., on this Service.

- We do not guarantee the availability of rest areas. Especially for items like benches, chairs, and sofas in facilities, please be aware that the number of seats, seat types, and locations are highly likely to change.
- This Site assumes no responsibility for any damages or troubles for any reason. At rest areas, please check and follow the local usage rules.
- This Site assumes no responsibility for any damages caused by advertisements for any reason.
- Please be especially careful when browsing the site on a smartphone, as high charges may be billed by the telecommunications carrier if you are not on a packet flat-rate plan. This Site assumes no responsibility for communication charges.
- Please understand that this disclaimer and information on this Site may be changed or deleted without notice.
9. Citation and Copyright

These copyrights are protected by the copyright laws of each country, various treaties, and other laws. Also, for the purpose of improving the Service, we will distribute email magazines to the registered addresses.
13. Member Qualification
If an applicant for enrollment in the Service falls under any of the following items, enrollment may not be accepted. Also, even after acceptance, if it is found that a member falls under any of the items, this Site may suspend or cancel the member qualification. If member qualification is canceled, the member shall lose all rights regarding the use of the Service under the name of the member at the time of cancellation. Furthermore, even if damage occurs to the enrollment applicant or member because this Site did not accept enrollment or canceled member qualification because of falling under the following items, this Site assumes no responsibility.
- If the enrollment registrant is under 12 years old.
- If not an individual.
- When applying for enrollment using another person's or imaginary personal information.
- If falling under members or affiliates of antisocial forces.
- If member qualification is currently suspended due to violation of these Terms at the time of application, or if member qualification was canceled in the past due to violation of these Terms.
- Other cases where this Site judges it to be inappropriate.
14. Loan/Transfer of Member Qualification
Member qualification cannot be loaned, transferred, or pledged to any person or corporation, and even if damage occurs to the member or other third parties due to such acts, this Site assumes no responsibility. Also, if damage occurs to this Site or third parties due to such acts, the member who performed the acts shall compensate for the full amount of the damage.
15. Suspension/Cancellation of Member Qualification
(1) If this Site judges that a member falls under any of the following items, this Site may suspend or cancel the member qualification for that member. Furthermore, if damage occurs to this Site or third parties due to suspension or cancellation of member qualification, the member shall compensate for the full amount of the damage.
- If information provided by this Site in the Service is modified without this Site's consent.
- If the operation of the Service is hindered.
- If the Service is used for an unjust purpose, or allowed to be used by other members or third parties.
- If there is fraud or a risk of fraud by a member or third party.
- If any clause of these Terms is violated.
- In the case of seizure, provisional seizure, provisional disposition, disposition for arrears, or compulsory execution against a member.
- If a member falls under members or affiliates of antisocial forces.
- Other cases where this Site judges it to be inappropriate as a member.
(2) If member qualification is canceled, the member shall lose all rights regarding the use of the Service at the time of cancellation.
16. Sponsors
- You can join as a sponsor member through a monthly recurring billing sponsor contract.
- Sponsors may be discontinued without notice.
17. Sponsor Prices
- Sponsor contract prices may be changed.
- At the time of a change in sponsor contract price, prior notice will be given to the registered email address of the sponsor member.
- We cannot take responsibility for non-delivery of price change notice emails based on the member's registered email address and email settings.
18. Sponsor Payment Method
- The payment method for sponsor fees is monthly payment by credit card or a method defined by this Site.
- The start date for charging sponsor fees shall be the date the member completes the application procedure.
- Monthly billing for sponsors is automatically renewed. Those who wish to stop automatic renewal should perform procedures from the member page.
- Sponsor members can terminate monthly billing at any time according to procedures prescribed by this Site.
- Even if the completion date of the application procedure or the end of use date is in the middle of a month, the full amount for one month belonging to each day will be charged.
19. Sponsor Application and Contract Establishment Timing
- The contract regarding use of the Service between the member and this Site (hereinafter referred to as "Use Contract") shall be established when this Site issues a license for the sponsor in response to the application procedure by the member.
- For sponsor contracts, approval from the credit card issuer is required. If approval from the credit card issuer cannot be obtained, sponsor contracts cannot be implemented.
- When minor members apply for sponsor contracts, consent from a person with parental authority or a guardian is required.
- Sponsor members shall not be able to transfer or sell the license (user ID) issued by us to a third party.
20. Sponsor Cooling-off
Except in cases where obvious disadvantage was suffered due to deficiencies in the Service, we cannot accept requests for cancellation of sponsor contract applications, termination of Use Contracts, or refunds after establishing a Use Contract. Please use the prescribed termination procedure for monthly billing.
21. Suwari Marche
Suwari Marche (hereinafter "Marche"), which is part of the Service, is defined as follows:
- Marche is a service that can be used through monthly recurring billing contracts.
- Marche may be discontinued without notice.
22. Marche Prices
- Marche usage fees may be changed.
- At the time of change in the Marche contract price, prior notice will be given to the registered email address of the user.
- We cannot take responsibility for non-delivery of price change notice emails based on the user's registered email address and email settings.
23. Marche Payment Method
- The payment method for Marche fees is monthly payment by credit card or a method defined by this Site.

26. Compensation for Damages
(1) If users, members, sponsor members, or Marche users cause damage to other members or third parties through the use of the Service, the users, members, sponsor members, or Marche users shall resolve it at their own responsibility and expense, and shall not cause damage to this Site.
(2) If the Site suffers damage due to acts in violation of these Terms or unjust or illegal acts by users, members, sponsor members, or Marche users, this Site shall be able to claim compensation for such damage against the users, members, sponsor members, or Marche users.
27. Access Analysis
- The Site uses "Google Analytics" provided by Google LLC and the Operator's own analysis tools (hereinafter referred to as "Analysis Tools etc.") for the purpose of improving the convenience and service of the Service, as well as improving the urban environment and supporting area management.
- Analysis Tools etc. use Cookies and local storage to collect traffic data and usage behavior data (search conditions, viewing areas, stay time, usage environment, etc.). This data is collected anonymously and does not identify individuals.
- The Operator may process the information collected based on this Article statistically and provide it to local governments, town planning organizations, real estate businesses, and other corporations etc.
- Users can refuse data collection by Analysis Tools etc. by disabling Cookies etc. via their browser settings.
28. Google Adsense
This Site has installed advertisements provided by Google and partners of Google (third-party distributors). For ad distribution, Cookies are used to distribute ads based on past access information to this Site.

29. Governing Law
Governing law regarding these Terms shall all be the laws of Japan. In the event of a dispute regarding the Service, the court having jurisdiction over the location of the operating company shall be the exclusive agreement jurisdictional court of the first instance.
Language Notice
These Terms of Service were originally created in Japanese. This English translation is provided for reference purposes only. In the event of any discrepancy or conflict between the Japanese version and this English translation, the Japanese version shall prevail.
